1. Agreement to Terms

Welcome to MindRise ("we," "our," or "us"). By downloading, installing, or using the MindRise mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use MindRise. By using the App, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

If you are under 18, you must have parental or guardian consent to use the App and make purchases.

3. Description of Service

MindRise is a mobile application that provides:

• Smart Alarms: Customizable alarm clock with professionally-recorded affirmations
• Professional Affirmations: Expertly-crafted affirmations delivered in multiple human voices
• AI Voice Coach (ARA): Conversational AI assistant for motivation, guidance, and wellness support
• Voice Recording: Ability to record and save personal affirmations
• Audiobook Library: Access to professionally-produced guided meditations, sleep stories, and wellness content
• Daily Affirmations: Curated daily motivational content
• Reminders: Customizable notification reminders

The App operates primarily offline (local storage on your device) with optional cloud features for AI chat and content delivery.

4. Subscription Plans & Pricing

4.1 Free Tier

The free version includes:

• 2 alarms (with 14-day trial for unlimited alarms)
• 10 lifetime AI text messages
• 3 lifetime voice coaching sessions
• Limited features

4.2 Premium Subscription

Price: $9.99 USD per month (auto-renewable)

Premium Benefits:

• Unlimited alarms and reminders
• Unlimited AI chat messages
• Unlimited voice coaching sessions
• Full audiobook library access
• Ad-free experience
• Priority support

4.3 Free Trial

New users may receive a 14-day free trial of alarm features. The trial starts when you create your first alarm. No payment is required during the trial. After 14 days, alarm features become limited unless you subscribe to Premium.

4.4 Payment & Billing

• Subscriptions are billed through Google Play Store (Android)
• Payment is charged to your Google Play account upon purchase confirmation
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Manage or cancel subscriptions in your Google Play account settings
• No refunds for partial subscription periods (see Section 5)

4.5 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing cycle but will apply upon renewal.

5. Cancellation & Refunds

5.1 Cancellation

You may cancel your subscription at any time through your Google Play account settings. Cancellation takes effect at the end of your current billing period. You will retain Premium access until that date.

5.2 Refund Policy

All sales are final. We do not offer refunds for:

• Partial months of subscription
• Unused Premium features
• Change of mind after purchase
• Technical issues resolved within 48 hours

Exceptions: Refunds may be granted at our sole discretion for:

• Billing errors
• Duplicate charges
• Technical issues preventing app use for more than 7 consecutive days

To request a refund, contact Google Play support directly (for subscription purchases) or email us at support@mindrise.club with your purchase details.

6. User Conduct & Prohibited Uses

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to hack, reverse engineer, or modify the App
• Use bots, scrapers, or automated tools to access the App
• Share your account credentials with others
• Upload harmful, offensive, or inappropriate content (in voice recordings or AI chat)
• Abuse or harass the AI assistant (ARA) or customer support
• Circumvent payment systems or subscription limits
• Resell or redistribute App content
• Use the App to harm, stalk, or harass others

Violation of these Terms may result in immediate account termination without refund.

7. AI-Generated Content & Limitations

7.1 Professional Affirmations & AI Voice Coach (ARA)

• AI-generated content (ARA chat responses) is provided "as-is" for motivational and entertainment purposes only
• Not a substitute for professional medical, psychological, or therapeutic advice
• AI responses may contain errors, inaccuracies, or biases
• We do not guarantee the accuracy, reliability, or completeness of AI content

7.2 Mental Health Disclaimer

7.3 No Liability for AI Content

We are not liable for:

• Actions taken based on AI-generated advice
• Harm resulting from reliance on AI content
• Inaccuracies, errors, or omissions in AI responses

You use AI features at your own risk.

8. User Content & Voice Recordings

8.1 Your Content

When you record voice affirmations or interact with AI chat, you create content ("User Content"). You retain ownership of your User Content.

8.2 License Grant

By uploading User Content, you grant MindRise a non-exclusive, worldwide, royalty-free license to:

• Store your voice recordings locally on your device
• Process AI chat messages to generate responses
• Use anonymized, aggregated data to improve the App

We do NOT:

• Sell your voice recordings
• Share your personal affirmations with third parties
• Use your voice for advertising or commercial purposes (without separate consent)

8.3 Content Removal

We reserve the right to remove User Content that violates these Terms, including content that is:

• Illegal, harmful, or threatening
• Infringing on intellectual property
• Spam or malicious

9. Intellectual Property

9.1 Ownership

MindRise and all content (affirmations, audiobooks, music, graphics, software code) are owned by MindRise or licensed to us. All rights reserved.

9.2 Restrictions

You may NOT:

• Copy, distribute, or sell App content
• Extract audiobooks or affirmations for use outside the App
• Create derivative works based on MindRise
• Remove copyright or trademark notices

9.3 Trademarks

"MindRise," our logo, and related marks are trademarks of MindRise. Unauthorized use is prohibited.

10. Third-Party Services

MindRise uses third-party services:

• Google Play Billing (for subscriptions)
• OpenAI API (for AI chat features)
• Cloud Storage (optional, for future sync features)

These services have their own terms and privacy policies. We are not responsible for third-party actions or data practices.

11. Privacy & Data Collection

Your privacy is important to us. Please review our Privacy Policy for details on:

• What data we collect
• How we use your data
• Your privacy rights (GDPR, CCPA)

By using MindRise, you consent to data collection as described in the Privacy Policy.

12. Disclaimers & Limitation of Liability

12.1 No Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

12.2 Alarm Reliability

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDRISE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages (lost profits, data loss, etc.)
• Damages exceeding the amount you paid to MindRise in the 12 months prior to the claim (max $120 USD)
• Damages resulting from:
  • Use or inability to use the App
  • AI-generated content
  • Data breaches or security issues
  • Third-party services

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless MindRise, its officers, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your User Content
• Your misuse of the App
• Your violation of third-party rights

14. Dispute Resolution & Arbitration

14.1 Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a claim, you agree to contact us at support@mindrise.club to attempt informal resolution. We will try to resolve disputes within 30 days.

14.3 Arbitration (US Users Only)

For users in the United States, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association. European users have the right to court proceedings under EU law.

14.4 Class Action Waiver (US Only)

US users waive the right to participate in class actions. European users retain all rights under EU consumer protection law.

15. Changes to Terms

We may update these Terms at any time. Changes will be effective:

• Immediately upon posting in the App (for non-material changes)
• 30 days after notice (for material changes affecting your rights)

Continued use of the App after changes constitutes acceptance. If you disagree with changes, stop using the App and cancel your subscription.

16. Termination

16.1 By You

You may stop using the App at any time. Cancel your subscription through Google Play to avoid future charges.

16.2 By Us

We may suspend or terminate your access immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the App or other users

Termination does not entitle you to a refund.

16.3 Effect of Termination

Upon termination:

• Your access to Premium features ends immediately
• Your data may be deleted after 90 days (unless required by law)
• Sections 9, 12, 13, and 14 survive termination
